BOOKING CONDITIONS – YES-TRIPS

All trips offered on Yes-Trips.com are organized and sold by Yes-Trip S.L., a company registered in Spain and based in Barcelona.

By completing a booking on Yes-Trips.com, the participant enters into a legally binding agreement with Yes-Trip S.L. and agrees to these Booking Conditions.

1.      Insurance

Yes-Trips is covered by a Tour Operator Liability Insurance with AXA Seguros Generales (Policy No. 86296469), which provides coverage in accordance with applicable legal requirements.

Please note that this insurance does not cover personal risks of participants. Personal travel insurance is not included in the trip price and is strongly recommended. We advise participants to obtain their own insurance covering, for example, medical expenses, accidents, trip cancellations, loss of personal belongings, and other travel-related risks.

Participants are responsible for ensuring that their insurance provides adequate coverage for the duration and nature of the trip.

2.      Minimum Number of Participants & Trip Confirmation

All trips are subject to a minimum number of participants. A trip will only be confirmed once this minimum number has been reached.

If the required minimum number of participants is not met, Yes-Trips reserves the right to cancel the trip up to 45 days before the scheduled departure date.

In the event of such cancellation, participants will be informed as soon as possible and will be entitled to a full refund of all payments made

3.      Force Majeure

Yes-Trips shall not be held liable for any failure or delay in the performance of its obligations where such failure or delay is due to events beyond its reasonable control (force majeure).

Such events may include, but are not limited to, extreme weather conditions, natural disasters, strikes, acts of government or authorities, pandemics, epidemics, travel restrictions, or other unforeseen circumstances that make it impossible or unsafe to operate the trip as planned.

In such cases, Yes-Trips reserves the right to modify, postpone, or cancel the trip. Where possible, we will offer suitable alternatives or solutions. However, refunds or compensation will depend on the specific circumstances and any costs already incurred.

Nothing in this clause shall limit or exclude rights granted to participants under applicable consumer protection laws.

4.      Cancellation Policy

Cancellation conditions may vary depending on the specific trip and will be clearly stated on each individual trip page.

We strongly recommend reviewing the FAQ section at the bottom of the relevant trip page for detailed information regarding the applicable cancellation policy before completing your booking.

By confirming your booking, you acknowledge and accept the cancellation terms associated with that specific trip.

In case you wanna cancel, Yes-Trips will, where possible, assist participants in finding a replacement traveler (for example, from a waiting list). However, the original participant remains fully responsible for reselling their ticket and arranging the payment directly with the new participant. Check point 6 for more information. 

5.      Ticket Resale & Name Changes

Participants may resell their ticket or request a name change, provided that Yes-Trips is informed in advance.

All name changes must be communicated within a reasonable timeframe before the trip and are only valid once confirmed by Yes-Trips. The participant is responsible for ensuring that all updated personal details are correct and complete.

Yes-Trips reserves the right to refuse name changes if they are requested too close to the departure date or if they affect bookings with third-party providers (such as flights, accommodations, or activities) that cannot be modified.

Any additional costs resulting from a name change or ticket transfer (e.g. administrative fees or third-party charges) may be charged to the participant.

6.      Price Errors

While Yes-Trips makes every effort to ensure that all prices displayed on the website, booking pages, and promotional materials are accurate, errors may occasionally occur.

In the event of a pricing error, Yes-Trips reserves the right to correct the price. If such an error affects your booking, you will be informed as soon as possible and given the option to either accept the corrected price or cancel your booking with a full refund of any amounts already paid.

Yes-Trips shall not be obligated to provide the trip at an incorrect price where the error is obvious and could reasonably have been recognized as such.

7.     Participants Responsabilities

Participants are responsible for ensuring that they have all necessary and valid travel documents, including passports, visas, and any required residence permits, in accordance with the regulations of the destination country.

Participants are also responsible for complying with any health requirements, including vaccinations or medical documentation, and for ensuring they are physically fit to take part in the trip.

It is the participant’s responsibility to arrive on time at all scheduled meeting points, departures, and activities. Yes-Trips shall not be held responsible for any missed services or additional costs resulting from late arrival or failure to follow the provided schedule.

8.      Itinerary changes

Minor itinerary changes may occur for operational or safety reasons. We warrant that for all changed arrangements we shall offer you a reasonable alternative that is in conformity with the details of your confirmed booking. A participant may transfer his or her booking to another person who satisfies all the conditions required. The transferor and the transferee shall be jointly and severally liable for payment of the balance due and for any possible additional costs.  You or the participant can request us to find another person to take over the booking and facilitate the transfer, however, we cannot be held accountable for this and the participant shall at no time have the right to obtain a refund from us.

9.  Behaviour

All participants must be at least 18 years old at the time of the trip.

Participants are expected to behave respectfully towards other travelers, staff, and third parties at all times, and to follow all applicable laws, regulations, and instructions provided during the trip.

Yes-Trips reserves the right to remove any participant from the trip, without refund, if their behavior is considered unsafe, disruptive, inappropriate, or harmful to themselves or others, or if it negatively impacts the experience of the group. In such cases, any additional costs arising (such as transportation or accommodation) will be at the participant’s own expense.

10.  Limitation of Liability

Yes-Trips shall not be held liable for any loss, theft, or damage to personal belongings during the trip. Participants are responsible for taking appropriate care of their own possessions at all times.

Furthermore, Yes-Trips acts as an intermediary for certain services provided by third parties (such as transportation providers, accommodation, or activity organizers). As such, Yes-Trips shall not be held liable for any acts, omissions, or failures of these third-party providers.

Nothing in this clause shall exclude or limit liability where it cannot be excluded under applicable consumer protection laws.

11.  Governing Law

These Terms and Conditions, as well as any agreements arising from them, shall be governed by and interpreted in accordance with the laws of Spain.

Any disputes, claims, or controversies arising out of or in connection with these Terms and Conditions, including their validity, interpretation, performance, or termination, shall be subject to the exclusive jurisdiction of the competent courts of Barcelona, Spain.

If you are considered a consumer under applicable law, you may also have the right to bring proceedings before the courts of your place of residence, in accordance with mandatory consumer protection regulations.

12.  Photographs and videos

During the trips we shall make videos and photographs in which you and your participants can be identified. By accepting these Booking Conditions you acknowledge that we have the right to use your and your participants’ image, likeness and sound of voice as recorded on audio or video tape without payment or any other consideration. 

The images may be edited, copied, exhibited, published or distributed without anyone’s approval and can be uploaded on social media. In case you or any of your participants have a reasonable objection against one or more of the videos or photographs taken during the trip you and/or the participant(s) shall have the right to request deletion of such video or photograph.

13. Data Protection

For booking a trip we require your and your participants’ personal details. We warrant that all personal details shall be treated with utmost care in conformity with the applicable Spanish Data Protection regulations. We shall not provide your details to third parties without your consent unless this is required for making bookings or other arrangements for the trip.

By making a booking through us, you agree we may use and disclose the information you provide for the following purposes: to enable us to process your booking (which will include passing your information to third party suppliers such as hoteliers and airlines, and may involve sending your information to countries that do not have an equal level of privacy legislation to that in The Netherlands); for market research and analysis purposes; for improving customer services; for the detection of fraud or other crime; and for compliance with legal requirements (which will include passing your information to public authorities such as customs and immigration).

14. Complaints

If you have a complaint during your trip you must notify our guide or representative who is leading your trip immediately and they will do their best to resolve the problem. Should it not be possible to resolve your complaint there and then, you should call or write to our office. Your complaint must be received no later than 28 days after your trip. Full details should be provided and you should cooperate in providing us with any evidence or additional information we might request. No claim or complaint will be entertained unless you follow this procedure. All complaints that are received are thoroughly investigated and you will be kept informed. We aim to settle all complaints amicably.

15. Payments

If you choose to pay in installments, you are responsible for completing all payments before the departure date. If the full payment is not received in time, you may not be allowed to participate in the trip. We reserve the right to deny participation if the payment has not been completed.

You will receive automatic payment reminders before the departure date.

If, for any reason, you have received the service without completing the full payment, you must settle the outstanding amount within 14 days after the trip ends. If payment is not made or is refused, we may take further steps to recover the outstanding balance. Any reasonable costs incurred in this process (such as administrative or legal costs) may be charged to you, in accordance with applicable consumer laws.

📌 Third-Party Bookings Disclaimer

If you have booked your trip through a third party (such as an ESN section, partner organization, influencer, or external platform), please note that their specific terms and conditions may also apply.

For any questions regarding your booking conditions, payments, cancellations, or modifications, contact the third party through which you made the booking directly.

Yes-Trips will of course assist where possible, but cannot be held responsible for policies, conditions, or agreements set by third parties.
